The Legal Affairs Committee of Parliament has launched an inquiry into allegations of corruption and other unethical practices involving Justice Kenan Manda.
Speaking after a successful committee meeting today in Lilongwe, Committee Chairperson Peter Dimba confirmed that the morning session was dedicated to discussing serious allegations against Justice Manda. The committee resolved to initiate a formal inquiry into the matter.
Dimba stated that the inquiry will involve summoning several individuals and institutions that have dealt with Justice Manda’s court, including cases like that of Salima Sugar Company.
“We expect to meet with the Malawi Law Society (MLS), which claims to have submitted a letter to Chief Justice Rezine Mzikamanda. We also welcome submissions from various institutions and individuals, including Lawyer Alexious Kamangira, to provide their accounts regarding Justice Manda’s conduct,” said Dimba.
He further emphasized the dangers of impunity, stating, “When people are not held accountable for their offenses, impunity thrives. And when the formal system fails to address such impunity, society becomes frustrated, leading to mob justice.”
Dimba also referred to previous concerns raised about Justice Manda, notably in the Kanengo filing station case, where Parliament had recommended impeachment proceedings. However, the Judicial Service Commission was entrusted to handle the matter, but instead of suspending the judge pending investigation, he was transferred from Lilongwe to Blantyre.
The inquiry is expected to last two to three weeks, after which the committee will present its findings in the next parliamentary session. Dimba indicated that if the allegations against Justice Manda are substantiated, the committee would recommend his impeachment.
In a letter dated October 13, 2024, the Malawi Law Society confirmed that it had submitted several complaints to the Chief Justice concerning Justice Manda’s conduct, reinforcing the seriousness of Lawyer Alexious Kamangira’s accusations.
Similarly, a joint statement from Civil Society Organizations (CSOs), dated October 14, 2024, called for a judicial inquiry into Justice Manda’s alleged misconduct. The statement highlighted concerns about recent allegations and stressed the need for judicial reforms to ensure accountability, transparency, and public confidence in the judiciary.
The Legal Affairs Committee of Parliament holds a constitutional mandate to oversee the administration of law and justice in the country.
