High Court in Blantyre has dismissed a case in which the former Chikwawa Mkombedzi legislator and former minister was challenging the September 16 parliamentary polls.
In her application, Mia accused the proclaimed member, Lloyd Laxton Malola, of duplicating the electoral results sheet, and that the sheets were collected by a single person.
Delivering his ruling, Justice Jabar Alide dismissed the case citing the reasons to be unsubstantiated.
Alide, however, acknowledged one irregularity about the absence of the presiding officer’s signature.
He further highlighted that oversight had undermined the integrity of the electoral process, although the mentioned irregularity had no effect on the official results.
Lawyer for claimant Asma Kapoto acknowledged the court’s note on the cited irregularity, which was in the application, a development he said is contributing to a failure of the judgment.
Malawi Electoral Commission (MEC) declared Democratic Progressive Party DPP candidate Malola a winner after amassing 12,218 votes.
Abida Miah, who was contesting on the Malawi Congress Party (MCP) ticket, only managed 7,687 votes, and the constituency saw four members racing for the parliamentary seat.
