Legal counsel for detained Malawi Congress Party (MCP) Secretary General Richard Chimwendo Banda has raised serious concerns over what he describes as unlawful detention of his client.
Lawyer George Jivason Kadzipatike says Chimwendo Banda has been in custody for three weeks without being formally brought before a court to answer charges.
Kadzipatike argues that the continued detention without court appearance violates the legal rights of the former cabinet minister.
He has also criticized the judiciary for delaying to deliver a ruling on a bail application that the defence submitted several weeks ago.
According to the lawyer, the lack of progress on the bail ruling has further worsened the situation, leaving his client in prolonged custody without clarity on his case.
Police arrested Chimwendo Banda, who is also the Member of Parliament for Dowa East Constituency, on 12 December 2025.
Authorities have linked him to alleged attempted murder and abduction cases said to have occurred in 2021.
At his last court appearance, Chimwendo Banda reportedly fell ill and received medical treatment, but his lawyer says the lawmaker remains unwell while still in detention.
