The Supreme Court sitting in Blantyre has adjourned for 30 minutes an appeal case challenging the remand order of Malawi Congress Party (MCP) Secretary General, Richard Chimwendo Banda.
The brief adjournment follows an objection raised by State lawyer Dzikondianthu Malunda, who argued that the appeal should not proceed due to technical irregularities.
Malunda’s objection prompted the court to pause proceedings in order to consider the legal basis of the appeal.
Presiding Judge, Justice Dorothy Nyakaunda Kamanga, is now addressing whether the Supreme Court has the jurisdiction to hear and determine the matter.
The court is expected to rule on the jurisdiction question before deciding on the substance of the appeal.
Chimwendo Banda is being represented by lawyer Khwima Mchizi in the proceedings.
The legal team maintains that the appeal was properly brought before the court.
Notably, there is a limited presence of MCP members at the court, with only Wycliffe Chimwendo, a brother to the accused, in attendance.
